Appeal filed by Calin Georgescu against decision to rerun presidential election, sent to Bucharest Court of Appeal

The Supreme Court decided on Monday that it does not have the competence to settle the appeal filed by Calin Georgescu in connection with the rerun of the presidential election, his request being sent to the Bucharest Court of Appeal.

The independent candidate Calin Georgescu on Monday challenged with the High Court of Cassation and Justice the decision of the Central Electoral Bureau (BEC) to rerun the presidential election, after the Constitutional Court of Romania annulled the results of the first round.

The CCJ ruled that it has no competence to judge such a request and referred the case to the Bucharest Court of Appeal.

This is a lawsuit in which Calin Georgescu and the Coalition for the Defence of the Rule of Law sued the Central Electoral Bureau and several institutions: the Ministry of Defence, the Defence Staff, the Government, the Prosecutor’s Office attached to the High Court of Cassation and Justice, the Constitutional Court, the Romanian Intelligence Service (SRI), but also President Klaus Iohannis and Elena Lasconi.

The main subject of the case file concerns the annulment of the Electoral Bureau’s decision, namely BEC decisions no.230D/2024, no.231D/2024 and no.232D/2024, which refer to the annulment of the entire electoral process and the rerun of the presidential elections from ground zero, based on the Constitutional Court’s decision.

On December 6, the Constitutional Court annulled the results of the first round of the presidential election, won by Calin Georgescu, on the basis of documents declassified by the Supreme Council for National Defence (CSAT), the Romanian Intelligence Service (SRI), the Foreign Intelligence Service (SIE), the Ministry of Internal Affairs (MAI), and the Special Telecommunications Service (STS) regarding the electoral campaign run by Calin Georgescu in the presidential elections.

The documents of the intelligence services show that Georgescu violated the electoral legislation regarding the financing of the campaign for the presidential elections, after having reported to the Permanent Electoral Authority zero expenses, while the SRI and MAI indicated that the financing of the campaign on TikTok was carried out by Bogdan Peschir and amounted to one million euros.

Also, the documents declassified by CSAT state that there have been actions of a state cyber actor on the IT&C infrastructures supporting the electoral process and that Romania is a target for aggressive Russian hybrid actions.
