CSM’s reaction to CCR ruling on judicial pensions law:Real inter-institutional dialogue between state powers required

In a reaction to the Constitutional Court ruling that the law on judicial pensions is unconstitutional, the Superior Council of Magistrates (CSM) said on Tuesday that this decision „calls for a real and honest inter-institutional dialogue between the state’s powers.”

„The Superior Council of Magistrates has taken note of the ruling of the Constitutional Court of Romania (CCR) passed on October 20, 2025, which found that the Law amending and supplementing specific regulatory acts in the line of service pensions is unconstitutional in its entirety. The decision of the constitutional watchdog, which sanctioned the absence of the CSM’s opinion in the submitted documentation reaffirms its role as guarantor of the independence of justice in the constitutional architecture and calls for a real and honest inter-institutional dialogue between the state powers, which would give effect to the principle of loyal cooperation between them,” the release notes.

Citing the same principle, CSM argues that any action by the legislative and executive powers that targets the judicial authority should be carried out with its effective consultation, so as to ensure full respect for the independence of the judiciary and the other constitutional values that set the framework in place for the act of justice to be truly in the interest of the citizen.

„Regrettably, these requirements were ignored by the political factor in the procedure for adopting the regulatory act that was declared unconstitutional, which caused the intervention of the Constitutional Court which, naturally, invalidated this action,” the Council emphasizes.

Consistent with the values of the rule of law enshrined in both the Constitution and international regulations, the Superior Council of Magistrates expresses its openness to dialogue with the other state powers, so as to identify appropriate solutions to clear away the real difficulties in the activity of the judicial authority, which have been repeatedly signaled, the release states.

The Constitutional Court of Romania upheld on Monday the challenge filed by the High Court of Cassation of Justice to the law on the pensions of magistrates, determining that the absence of an opinion from the Supreme Council of Magistrates on the said piece of legislation, corroborated with the government cutting corners and prematurely ending the 30-day legally mandated timeframe for obtaining it, are in violation of several articles of the Constitution.
