Deputies Chamber: Romanian Army structures – temporarily transferred under foreign army command

The Chamber of Deputies on Wednesday adopted a draft law regulating the peacetime conduct of military missions and operations on the territory of the Romanian state.

There were 201 votes cast „in favour”, 100 „against” and one abstention.

According to the draft law, the designated structures of the Romanian Army, depending on operational needs, will be able to be transferred, for determined periods of time, under different degrees of authority, in the relationship with the commander of the foreign armed forces leading a military operation on the territory of the Romanian state.

The draft regulates the peacetime conduct of military missions and operations when a state of emergency or a state of siege is not being established or a state of mobilization or a state of war is not declared.

The conduct of these military missions and operations will be carried out in the event of the imminence or existence of actions, facts or states of affairs, capabilities, strategies, intentions or plans that may affect national security values, interests and objectives and/or are likely to directly or indirectly endanger national security, by affecting the national character, sovereignty, independence, territorial unity and integrity, the normal functioning of state institutions and administrative-territorial units, the life and physical integrity of citizens, the normative act provides.

Also, military missions and operations are carried out by the armed forces exclusively or with the participation of foreign armed forces, in compliance with Romanian legislation, international treaties, bilateral and multilateral agreements and technical agreements concluded with foreign armed forces.

„The initiation of military missions and operations on the territory of the Romanian state is approved by the president of Romania, upon the proposal of the Supreme Council for Country Defence, provided that the indicators and warnings established by the plans show a deterioration of the international or regional security environment and the imminence of security risks to the Romanian state,” the draft stipulates.

The president of Romania informs the Parliament within 5 days of the decision taken, and if the Parliament is in recess, at the beginning of the ordinary or extraordinary session, as the case may be.

The leadership and execution of military missions and operations are carried out in accordance with the planning and leadership documents approved by the relevant authorities, provided for by the Law on National Defence of Romania no. 45/1994, with subsequent modifications and completions.

Depending on the dynamics of the operational situation, the chief of the Defence Staff may order the termination of the transfer of authority over the forces of the Romanian Army participating in military missions and operations on the territory of the Romanian state.

The funds necessary for the participation of the Romanian Army forces in military missions and operations on the territory of the Romanian state are provided from the state budget, through the budget of the Ministry of National Defence.

Representatives of AUR (Alliance for the Union of Romanians) and S.O.S. Romania criticized the project, claiming that it violates the Constitution, while USR (Save Romania Union) and PNL (National Liberal Party) showed that the normative act is important for protecting the citizens.

The Chamber of Deputies is the first chamber voting on this project, while the Senate is the decision-making forum. \
