Ombudsman notified by USR about the Pension Law, invoking the violation of the contributory principle

Save Romania Union (USR) Gorj MP Radu Miruta notified the Ombudsman about the fact that the new Pension Law „violates the principle of contribution and stability” in the case of current and future pensioners who have worked for decades in special work conditions.

„The PSD (Social Democratic Party, ed. n.) minister of Labour and other PSD representatives say that they have been privileged so far, totally ignoring the fact that the state has collected from them, month after month, additional contributions of 8-10% in relation to the employees who worked under normal conditions,” a press release by USR reads.

Radu Miruta emphasizes that the pensions of miners, steelworkers and other categories who worked in special and particular conditions are not special pensions.

„This is the deception that those from the PSD are trying to push these days. Both the PSD minister of Labor and the president of the National Pension House, appointed by the PNL (National Liberal Party, ed. n.), dare to say that fairness has been achieved, that those with special labour groups have had privileges. Nothing more false! The truth is different and must be defended. Almost 800,000 people are wronged by the new pension law and this cannot be reversed by PSD propaganda, regardless of how much money PSD pays for it,” the MP says.

USR requests the Ombudsman to order the referral of Law 360/2023 to the Constitutional Court. According to the law, the social insurance rights must reflect the contributions paid throughout the professional career, which does not apply to those who worked in special work conditions, the release states.

„They were obliged to pay an additional contribution – initially 10%, currently 8% – for the entire duration of their activity, a contribution intended to provide them with additional seniority, as well as the multiplication of the monthly score proportional to the salary obtained. The recalculation decisions received these days, with pension reductions even of over 4,000 RON reveal that these people have paid extra for nothing, they no longer receive anything in return,” USR says.

„USR drew attention to the injustices of the new Pension Law as early as November 2023, during the so-called parliamentary debates made on the fly by PSD and PNL, after they came up with the draft law with a delay of almost three years from the deadline established in the National Recovery and Resilience Plan. When the USR amendments were rejected on the conveyor, the USR submitted a separate bill for the correction of the aberrations regarding the special work conditions,” the press release states.

At the same time, USR requested the convening of an extraordinary session of the Parliament to „resolve the injustices” of the new Pension Law.
