Presidential election 2025/CCR’s Enache: Court cannot be influenced or threatened by any form of pressure

Chairman of the Constitutional Court of Romania (CCR) Marian Enache said on Friday that the constitutional court cannot be influenced or threatened by any form of pressure.

The statement was made after the Constitutional Court Decision 7/2025 on the rejection of the appeals filed against the Central Electoral Bureau (BEC) regarding the independent candidacy of Calin Georgescu in the presidential election was sent to the Official Journal for publication.

„Lately, we can observe a consistent and systematic action of discrediting and devaluing on a large scale the constitutional legal argumentation that underpins the rulings and decisions of the Constitutional Court of Romania. We are aware that the activity of the Constitutional Court, in relation to its role and powers, was and will always be subject to both public appreciation and criticism. By its essence, any form of justice, even more so constitutional justice – which has mainly a preventive, not a punitive role – creates by its rulings and decisions the premises of inherent criticism from those who consider themselves wronged by the solution adopted. These criticisms are natural and proof that in Romania political pluralism and pluralism of opinions is one of the principles of the democratic constitutional order,” Enache is quoted as saying in a CCR press statement released on Friday.

He adds that in Romania, as a member state of the EU and NATO, there is a constitutional and legal order that has to be observed.

„At the same time, even if we understand that during electoral periods, ideological, doctrinal or personal passions and partisanship can generate social tension that goes beyond the realm of habit, we must reaffirm that in Romania, as a member state of the EU and NATO, therefore part of the Western democratic space, there is a constitutional and legal order that must be observed, as an expression of the sovereignty and of the state and societal unity, of the constitutional identity of the Romanian state.”

Enache adds that CCR, as the constitutional court through which constitutional justice is achieved, „cannot be influenced or threatened by any form of pressure, having not only the role, but also the constitutional obligation to guarantee the supremacy of the Constitution through the effective exercise of its powers, and in a state of law, criticism is welcome, while pressure is unacceptable and condemnable.”
