President Klaus Iohannis promulgated on Tuesday the law that establishes that the elections for the president of Romania can take place no more than 3 months before the month when the presidential mandate expires.
According to a press release sent by the Presidential Administration, it is about the Law amending art. 5 of Law no. 370/2004 for the election of the President of Romania.
„Election day is Sunday. Elections take place no later than 3 months before the month in which the mandate of
president ends. At least 75 days before the voting day, the Government establishes the date of the elections by decision”, the law states.
The Constitutional Court of Romania (CCR) unanimously rejected, on March 20, a referral made by Save Romanian Union (USR) and non-affiliated deputies, establishing that the draft law that allows the date of the Romanian presidential elections to be brought forward is constitutional.
CCR shows that the amendment criticized by USR re-sizes the time interval in which the election date is to be set, „which does not call into question a fundamental element of electoral law”.
