Deputies Chamber/Labour committee modifies draft on magistrates’ pensions

The labour committee of the Chamber of Deputies on Wednesday modified the draft law on magistrates’ pensions, initiated by the leaders of the governing coalition, after issuing a positive opinion a day earlier on its initial form.

The committee eliminated the tables that staggered the retirement age of magistrates, so that in 2045 the standard retirement age would be 65 years.

The method of calculating magistrates’ pensions was also modified and an amendment by the USR (Save Romania Union) was accepted in this regard.

„Judges, prosecutors, judges of the Constitutional Court, assistant magistrates of the High Court of Cassation and Justice and of the Constitutional Court, as well as legal personnel with at least 25 years of service in these positions alone may retire upon reaching the standard retirement age of 65 and may benefit from a service pension in the amount of 80% of the calculation base represented by the average of the monthly gross employment allowances and the increases received in the last 48 months of activity before the date of retirement. The net amount of the service pension may not be greater than 100% of the net amount corresponding to the monthly gross employment allowance received in the last month of activity before the date of retirement,” this amendment states.

According to the head of the labour committee, Adrian Solomon, following these changes, starting January 1, 2026, magistrates will retire at the age of 65.

„There is also the decision-making debate in the Senate, where our wiser colleagues than us will manage to solve the problem and make an appropriate schedule,” Solomon said.

The bill will enter the debate and vote of the Chamber of Deputies’ plenary session on Wednesday.
