Fenechiu, about AUR’s appeals to CCR: It is normal for them to fail;argument does not exist

The leader of the PNL senators, Daniel Fenechiu, declared on Tuesday that it is normal for the Constitutional Court to reject the appeals filed by AUR against the projects for which the Government assumed responsibility, noting that the „argumentation” in these appeals „does not exist”.

„I believe that all the appeals will fail. I believe that it is normal for the appeals to fail, because I have also seen the argument. The argument does not exist,” said Fenechiu.

He was asked about Prime Minister Bolojan’s statements that he would leave office if the projects were rejected by the CCR.

„There is a nuance there. Prime Minister Bolojan is not a lawyer, I am convinced that Prime Minister Bolojan wanted to say something else. In the matter of a challenge to the Court, there are not only two solutions, there are three solutions. There is the solution of rejecting the challenge, there is the solution of admitting the entire law as unconstitutional (…) and there is the option of admitting it in part, on some aspects. Now, I am not putting my hand on fire that the Court will not tell us, in its wisdom, given the connection between the magistrates and the Court: wait a minute. As it told us that we rushed when we made the special pensions. (…) The Court may tell us that the transitional measures do not respect I don’t know what, it was 10 years, maybe it should be 12 or maybe the 70% pension should be 75% on I don’t know what Convention. This could be predictable. In a situation like this, Bolojan has no reason to resign because his law passed and there were some observations, which can be agreed upon by Parliament. This is my opinion,” explained Fenechiu.

He specified that Prime Minister Bolojan said he would leave if he could do nothing. „So, the explanation is as clear as can be, it’s not a new thing, out of arrogance,” Fenechiu added.

The project was evaluated by the former president of the Court, by judges at the Court, Fenechiu also said….

„Everyone said that if there are transitional measures and a clear law, there are no grounds for unconstitutionality,” he pointed out.

AUR announced on Tuesday that it had challenged at the CCR the projects imposed by the Bologna Government through liability.

„The Alliance for the Unification of Romanians has filed four complaints of unconstitutionality with the Constitutional Court against the packages of laws imposed by holding the Bologna Government accountable, without parliamentary debate, without consulting the Romanians and without a democratic vote. Through this maneuver, the executive power has confiscated the role of Parliament and trampled on the fundamental principles of the rule of law,” AUR said in a statement.

At the same time, the High Court challenged the law regarding the service pensions of magistrates, for which the Government assumed responsibility in Parliament, at the Constitutional Court.

On Sunday, the Parliament’s plenary session rejected all four motions of censure submitted by AUR, S.O.S. Romania and POT on the Government’s assumption of responsibility for four projects from the second package of measures.
