Declic files first climate lawsuit in Romania against Government, demands fining prime minister

The Declic Community filed on Tuesday the first lawsuit regarding the climate in Romania, against the Romanian state, through which it demands, among other things, fining prime minister Nicolae Ciuca and the ministers of Environment and Energy, according to Agerpres.

„The Declic community submitted, on Tuesday, January 31, 2023, to the Cluj Court of Appeal, the documents for the first lawsuit regarding the climate in Romania, by which the Romanian state is taken to court. Declic asks the judges to force the Government to take concrete actions to combat the changes Moreover, the Declic members demand in court fining prime minister Nicolae Ciuca, the minister of Energy, Virgil Popescu, and the minister of the Environment, Tanczos Barna, for each day they postpone the measures,” reads the Declic Community release.

According to the said source, Declic invoked in the action at the Cluj Court of Appeal, the fact that the Government’s inactivity affects „the right to life and the right to private life, the right to property, the right to a decent living, the right to a healthy and sustainable environment and the right to a dignified future of future generations”.

„The state has the obligation to take measures to ensure a healthy and sustainable future for all citizens,” it is stated in the action submitted to the Cluj Court of Appeal.

„Therefore, Declic requests in court: ‘The obligation of the defendants Nicolae Ionel Ciuca, Tanczos Barna and Virgil Popescu to pay a fine of 20% of the gross minimum salary per day of delay, which is paid to the state budget, until the effective adoption of the measures required to achieve the foreseen objectives’. The goal of the lawsuit is that the court oblige the Romanian state, through a judicial decision: 1. to take all the necessary measures in order to reduce greenhouse gases by 55% until the year 2030, i.e. the achievement of climate neutrality until the year 2050, measures that will be materialized in a written commitment within 30 days from the definitive stay of the decision,” states the release.

It also demands that the Romanian state take all the necessary measures in order to increase the share of renewables in the final energy consumption to 45% and to increase energy efficiency by 13% until the year 2030.
