Supreme Court dismisses AUR’s challenge against Constitutional Court’s decision to annul presidential elections

The High Court of Cassation and Justice (ICCJ) on Wednesday rejected the appeal filed by the Alliance for the Union of Romanians (AUR) against the Constitutional Court’s decision on the annulment of the entire electoral process of the presidential elections.

The reason for the rejection of AUR leader George Simion’s appeal is that the courts do not have the power to annul a Constitutional Court decision.

„Admits the exception of the general lack of jurisdiction of the court, raised ex officio. Dismisses the appeal for annulment lodged by the petitioner Simion George Nicolae against Decision No. 32 of December 6, 2024 of the Constitutional Court, on the annulment of the electoral process regarding the election of the President of Romania in 2024, as inadmissible. Definitive,” reads the court’s decision.

In the complaint lodged with the High Court, AUR chairperson George Simion, states that the decision made by the constitutional judges on December 6 is „an extremely dangerous precedent, as it violates Article 2 of the Constitution, which states that „national sovereignty belongs to the Romanian people and is exercised through its elected representatives”, repeatable every time the power wants to remain stable in power, therefore not replaceable through elections, and on the other hand, it is a very serious motivation for the people to lose confidence in democracy, elections and the rule of law”.

The AUR leader also mentions that the same judges from the CCR decided, on December 2, to validate the first round of the presidential election.
