Constantin Popescu, the policeman who fatally injured Raisa, a 13-year-old girl, in January 2022, was definitively sentenced, on Tuesday, by the Bucharest Court of Appeal (CAB), to three years in prison with execution for committing the crimes of murder from negligence and personal injury due to negligence.
Initially, in January, Constantin Popescu had received a suspended sentence, but the CAB accepted, on Tuesday, the appeal made by the prosecutors and Raisa’s family and decided that the policeman should remain in detention.
„Remove the provisions regarding the suspension of the execution of the sentence under supervision applied to the defendant Popescu Constantin. The resulting sentence of 3 years imprisonment applied to the defendant Popescu Constantin will be executed in detention, according to art. 60 Penal Code,” the sentence states.
The Court of Appeal also decided that the insurance company City Insurance SA (in bankruptcy) should pay moral damages of 700,000 euros to the civil parties in the case.
On January 13, 2022, on Laminorului Boulevard in Sector 1 of Bucharest, a police car driven by Constantin Popescu hit two girls on the pedestrian crossing. Raisa died on the spot, while the other girl was injured and transported to the hospital.
The prosecutors established that the policeman was driving at high speed and did not give priority to pedestrians.
Constantin Popescu, employed in the Police since 2017, was tested with the breathalyzer, and the result was zero.
