Trafficking in human beings committed by a public servant in the exercise of his or her official duties or by a person who has previously committed an offense against sexual freedom and sexual integrity, an offense of child pornography, an offense of trafficking in persons, trafficking in minors or pimping is punishable by imprisonment from 7 to 15 years, according to the law promulgated on Wednesday by President Klaus Iohannis.
The normative act in question modifies and adds Law 286/2009 on the Criminal Code. According to the new rules, it is deemed as exploitation of persons and forcing them to commit acts under criminal law.
It is also punishable to induce the initiation or continuation of prostitution if it has been carried out by methods defined as trafficking in persons.
Trafficking in minors is punishable by 10 to 20 years imprisonment and disqualification from exercising certain rights when the act has been committed by a person who has previously committed an offense against sexual freedom and sexual integrity, a child pornography offense, a trafficking in persons, trafficking in minors or pimping.
